Introduction
Welcome to IN THE MAKING /! These Terms of Service govern your use of inthemakingcanada.com and our services, including live customization, embroidery, print and patch bars, personalized products and related offerings.
By using our website, placing an order or booking our services, you agree to these terms and the arrangements confirmed in your written quotation or booking agreement.
Nothing in these terms limits rights or remedies that cannot lawfully be excluded.
User Responsibilities
Please provide accurate contact information, event details and personalization instructions.
You are responsible for ensuring that you have permission to use and reproduce any photographs, artwork, logos or other content you submit.
Our website and services must not be used for unlawful, fraudulent or abusive purposes.
Orders & Bookings
Submitting an inquiry does not confirm an order or reserve an event date.
We will discuss availability, pricing and your requirements before accepting an order or booking. The agreed products, services, timing and other arrangements will be confirmed in writing.
Changes requested after confirmation or design approval may involve additional charges or delays.
Payment & Deposits
Event bookings: A 50% deposit is required to secure your booking after we have accepted it. The remaining balance is due 7 days before the event, unless otherwise agreed in writing.
Personalized orders: Full payment is required before production begins.
Production begins only after we have received the payment required to begin production, as specified in your order or booking agreement.
Payments are made by Interac e-Transfer. Prices are in Canadian dollars, and applicable taxes and additional charges will be disclosed before purchase.
Cancellation & Refund Policy
Event cancellations: Cancellations received 30 days or more before the event qualify for a full deposit refund. For cancellations received less than 30 days before the event, the deposit is non-refundable, except where a refund is required by applicable law.
Rescheduling: Please request a date change at least 21 days before the event. Rescheduling is subject to availability. Your deposit will transfer to the confirmed new date. If no suitable date is agreed upon, the cancellation policy applies based on when we received your request.
Personalized orders: Once production begins, personalized items are generally not eligible for change-of-mind cancellations, returns or exchanges. This does not affect remedies for defects, production errors or other rights under applicable law.
Cancellation by IN THE MAKING: If we cancel your booking and you do not accept an alternative arrangement, we will refund all payments received for that booking.

Service & Product Details
Available products, customization options, production times and event requirements vary by order or booking and will be confirmed with you.
Customer-supplied items require our approval before customization.
Please follow the care instructions provided with your finished products and any safety instructions given during an event.
Intellectual Property
Our original branding, website content, photographs and designs belong to IN THE MAKING or their respective owners. Commercial use or reproduction requires permission.
You retain your rights in content you provide and authorize us to use it as necessary to fulfill your order or booking. Purchasing a finished product does not automatically transfer copyright in its design.
Photography & Marketing
Unless otherwise agreed in writing, we may photograph completed products and event setups for our portfolio, website, social media and promotional materials, subject to applicable privacy and intellectual property requirements.
Please let us know beforehand if you require confidentiality or restrictions on promotional use. Appropriate permission will be obtained where required for private customer photographs or identifiable guests.
Privacy
We use personal information to respond to inquiries, fulfill orders, coordinate services and operate our website. We do not sell personal information.
Our Privacy Policy explains how information is handled, including necessary processing by service providers.
Disclaimer of Warranties
Customization results may vary according to materials, product construction and design. Minor differences in colour, texture and placement may occur, and digital previews may differ from finished items.
We do not guarantee uninterrupted or error-free website operation. Nothing in this section excludes responsibility for defects, production errors or warranties and remedies required by law.
Limitation of Liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses arising from our website, products or services.
Where legally enforceable, our total liability for a particular order or booking will not exceed the amount paid for it. This does not limit liability that cannot lawfully be excluded, statutory remedies or refunds promised under these terms.
Indemnification
To the extent permitted by law, you agree to indemnify IN THE MAKING against third-party claims and reasonable, documented losses directly caused by your unlawful conduct or submission of content without the necessary rights.
This does not cover losses caused by our own negligence or misconduct.
Governing Law
These terms are governed by British Columbia law and applicable federal Canadian law, subject to mandatory protections that apply to you.
We welcome the opportunity to resolve concerns through discussion. These terms do not require arbitration or restrict lawful reviews, class proceedings or other legal remedies.
Changes to These Terms
We may update these terms for future orders and bookings. Updates will not change an existing confirmed agreement without your consent, except where required by law.
